Wells Fargo Foreclosure Lawsuit

My client was offered a loan in 2007 by a broker who worked with Wells Fargo. His income at the time did not really support the loan, and he was hoping that the real estate would lift the value of his home. This, unfortunately, did not happen and over time, he was no longer able to keep up with his mortgage payments. As required by law, the bank sent a Notice of Intent to foreclose which notified my client how much he owed on the mortgage in order to make it current. Wells Fargo filed a Foreclosure lawsuit in Montgomery County Court of Common Pleas in 2010. I defended the lawsuit, and after motion practice and quite a bit of discovery, Wells Fargo withdrew the lawsuit. Three months later, however, Wells Fargo initiated a new lawsuit, again in the Montgomery County Court of Common Pleas.

Wells Fargo, however, did not send my client a new and updated Notice of Intent to foreclose before they filed the second lawsuit. After discovery, the bank filed a motion for summary judgment and the trial court granted the motion which gave the bank the right to foreclose. I argued that Wells fargo was required to send my client a new, updated Notice of Intent, and since they did not, then the foreclosure was unlawful.

I filed an appeal to the Pennsylvania Superior Court on the grounds that the lender was required to send an update Notice of intent before they filed a second lawsuit. Wells Fargo opposed the motion by claiming that it was nothing more than a formality and since the first Notice of Intent was sent, there was no need to send a revised one.

The Superior Court agreed with me and reversed the trial court’s order of summary judgment. Wells Fargo filed a motion for reconsideration which was denied on January 4th, 2015. I expect there will be an appeal to the Superior Court. The current status is Wells Fargo is attempting to take ownership of the home upon which they wrongfully foreclosed so I am considering filing a lawsuit against Wells Fargo to redress my client’s damages. -Michael Gaier

New Jersey Foreclosures Lead the Nation

As of November 2014, information released by the Mortgage Bankers Association indicates New Jersey leads the nation in foreclosures. For the most part, the foreclosure crisis that followed the 2008 financial meltdown has abated and returned to levels seen before the 2008 recession. In New Jersey, however, one in six home mortgages is either delinquent or in foreclosure. While the percent of mortgages in foreclosure or delinquent is slightly less than this time last year (8 percent and 7 percent respectively in November of 2013), New Jersey is still posting foreclosure rates substantially higher than the national average.

Why Foreclosures are Higher in New Jersey

Part of the reason why New Jersey’s foreclosure rate is so high at this time is due to how foreclosures are handled in New Jersey. Under state law, foreclosures must go through the courts, which inevitably prolong the process. Additionally, due to a near halt in foreclosure activity in 2011 after questions regarding allegations of abuse and fraud in the mortgage industry, the system now has to play catch up.

Interestingly enough, most of the troubled mortgage loans are ones that were made prior to 2007.  According to Mike Fratantoni, the chief economist for the Mortgage Bankers Association, 74 percent of delinquent loans were made before the beginning of the 2007 sub-prime mortgage crisis.

Foreclosure – Not so Straightforward

Based on a recent study conducted by RealtyTrac, foreclosure filings for the year 2013 totaled 1.36 million properties in the continental United States. Although this number has decreased by approximately 26% from 2012, the total number of Americans facing foreclosure is vast. FORECLOSURE ERRORS CONFIRMED

On Wednesday, April 30, 2014, a Federal regulator confirmed that the biggest banks committed widespread errors when dealing with homeowners who faced foreclosure at the height of the mortgage crisis. The report released by the Office of the Comptroller of the Currency was really a post-mortem of the earlier-released Independent Foreclosure Review, a very expensive review though limited in scope, of how the banks mistreated homeowners in the foreclosure process.

Almost 10% of the errors discovered in the review involve situations when banks improperly denied loan modifications that would have prevented a foreclosure filing in the first place. Many of these errors involved administrative flaws and improper fees being charged to the homeowners during the foreclosure process. In 2013, however, 15 banks settled with banking regulators making payments that totaled $3.9 billion, paid out to more than 4 million homeowners (averaging about $1,100 per household). These settlements ended the Independent Reviews, and the banks agreed to pay homeowners regardless of whether they had been harmed. The banks and regulators agreed to halt the review process because it was so expensive and lengthy, even though only a small fraction of the mortgage files were reviewed.

The report released on April 30 showed that the banks had made even less progress in the reviews than was previously disclosed. For example, Bank of America reviewed only 6% of its files, yet revealed a financial error rate of nearly 9%. Wells Fargo examined less than 10% of its records, and found an error rate of nearly 11.5%. Parties on both sides of the crisis were not pleased, and one reason could be that the decision to cut short the review left regulators with limited information about actual harm to borrowers, even though there was a multi-billion dollar settlement.

Multi – Million Foreclosure Rescue and Real Estate Ponzi Scheme in New Jersey

May 14, 2014 – FBI Special Agents in Philadelphia arrested a New Jersey man Wednesday morning for allegedly operating a multi – million dollar ponzi scheme involving foreclosure rescue and real estate investment. An operator of Equity Capital Investments, LLC (and the former president of the South Jersey Real Estate Investment Club), Randy Poulson of Woolwich Township, New Jersey, is charged with using his investment company to scam property investors. Mr. Poulson is also accused of stealing the deeds from 24+ struggling homeowners who were facing foreclosure.

Poulson allegedly devised a two-part scam in which he promised distressed homeowners, who were facing foreclosure, that he would pay for their mortgages if they sold their homes to him. They did this by signing over the deeds to their home to Poulson. He then had the victims vacate their homes so that renters could move in. Then, he ceased making mortgage payments to the original home owner’s lender.

Part two of Poulson’s scheme involved soliciting 50+ private investors. He pitched investors at seminars, speeches and dinners he attended to invest in real estate and properties for rehabilitation. He advised them that he would be able to sell these investments for a return of 10 to 20 percent. Poulson created fake mortgages and promissory notes to give to investors in order to legitimize his company.

Randy Poulson pocketed both the homeowners’ and the investors’ money for his own personal use. Poulson spent the money at Acme, Exxon/Mobil, Jos. A. Bank, DirecTV, Hollywood Grooming, Kiddie Garden, Philadelphia Union tickets, American Express, Studio 122 (a hair salon), The Disney Store, Toys ‘R Us, Wawa, eating at Ray’s Pizza, and payments on a personal beach house in Ventnor, New Jersey.

Despite Housing Market Turnaround, Foreclosures High

Data released in late January notes that New Jersey may become the nation’s leader in the number of foreclosed homes by summer 2014. Mark Fleming, a chief economist for the online analytic firm CoreLogic.

Since the real estate bust in fall 2008, Florida had the highest percent of foreclosed homes, with New Jersey coming in second. By 2013, slightly over 10 percent of Florida homes with mortgages had undergone foreclosure. In contrast, New Jersey’s rate was slightly over 7 percent. It seems that New Jersey is going through the process much slower than Florida.

In fact, in the past year, while Florida competed 119,000 foreclosures, New Jersey’s completed just 5,138. It evidently takes about 1,002 days to resolve foreclosures in the Garden State, while the Sunshine State completes them in 883 days.

Foreclosure Backlogs in New Jersey

New Jersey’s struggles escalated when the state Supreme Court ordered the six largest banks to review their procedures for lending money. Filings at that time fell from 58,000 in 2010 to 6,000 in July 2011, creating a significant backlog.

It will be just a matter of time before New Jersey gets to the top of the list. The good news is that home sales have reached their highest levels since 2005, up about 18 percent in 2013.

RELIEF FOR SOME HOMEOWNERS – BUT THEN A TAX BILL?

The big banks will be able to write-off the billions of dollars in debt relief they agreed to give to homeowners, but for the homeowners that received that help, the debt relief is treated as taxable income, which can result in large tax bills. There had been a tax exemption for mortgage debt forgiveness, but Congress let this expire on December 31, 2013. While Congress often allows tax breaks to expire, only to reinstate them later, the mortgage debt relief exemption has not yet occurred. This could partly be because there is a movement in Congress to broadly overhaul the entire tax code, and in an election year, this year was considered “small” relative to other tax matters that affect the nation as a whole.

The tax exemption helped homeowners who are underwater in their mortgage – that is, those who owe more on their mortgage than their home is worth (approximately 6.4 million households nationwide). Put in real terms, this means that if you owe $250,000 on your mortgage, and your bank lets you sell it by way of a short sale for $150,000, then the $100,000 difference is treated as taxable income. This would lead to an approximately $28,000 tax bill because of the typical tax laws in which if someone lends you money and then later says you do not have to pay it back, the IRS counts the amount forgiven as income (except in cases of bankruptcy or insolvency). Nationwide, approximately 100,000 people used the mortgage debt relief exemption in 2011. In 2013, however, that number will be much greater, simply because there were approximately 250,000 short sales, yielding an average debt reduction of approximately $37,000. A homeowner in the 25% tax bracket would then face an extra $9,250 tax bill.

What remains to be seen is if Congress recognizes the unfairness of giving the banks a welcome form of tax relief, while piling even more debt upon the innocent homeowner.

SUPERIOR COURT UPHOLDS DEFAULT JUDGMENT AGAINST BANK OF AMERICA

We sued Bank of America on behalf of our client in a classic case of predatory lending (bait and switch, undisclosed terms, etc.). The lawsuit was filed on August 31, 2012, and we served it on Bank of America by regular and certified mail, as the court rules permit, on September 5, 2012. Bank of America failed to respond, and I secured a default judgment against Bank of America on October 31, 2012.

Over a month later, on December 12, 2012, Bank of America filed a petition to open the default judgment, claiming that I improperly served the complaint. On a side note, Bank of America was served at their Plano, Texas Mail Center, and Bank of America concedes that this center is a regular place of business or activity. Also, I’ve served BoA dozens of times at that address and there were never any problems before.

On March 27, 2013, Judge Burr of the Delaware County Court of Common Pleas denied Bank of America’s petition to strike or vacate the default judgment. The court’s opinion is here. Bank of America appealed to the Superior Court of Pennsylvania. On December 22, 2013, the Superior Court affirmed Judge Burr’s decision that the default judgment was proper. The crux of Bank of America’s argument was that service of process was deficient in two regards. First, it claims that the “mail center” is not a person, but rather a place. This, despite the fact that a bank employee physically stamped the lawsuit papers as “received”, was not persuasive to the Superior Court. Second, Bank of America maintained that proper service requires a signed receipt, and the mail center’s stamp was not sufficient. This was also dismissed by the Superior Court as not persuasive.

As service of the lawsuit has been deemed proper by the Superior Court, the default judgment remains in place. It is unknown whether Bank of America will file an appeal.

Favorable Settlement During Trial in Philadelphia

Our client had been sued by HSBC, one of the world’s largest banks (its initials stand for Hong Kong Shanghai Banking Corporation). In 2010, my client’s employer cut back on his overtime hours, and this caused a decrease in take-home pay. During the build-up to the housing bubble, HSBC acquired hundreds of thousands of U.S. mortgages from smaller lenders. Many banks got bailed out, but HSBC did not, and now claims that since it did not take any federal bailout money, it does not have to adhere to federal guidelines to modify mortgage loans, or engage in what I call reasonable settlement/resolution practices.

HSBC, therefore, demanded that the only way to reinstate my client’s delinquent loan was for the him to come up with 40% of the arrears. For homeowners that have been in foreclosure for a year or more, this often means that HSBC will not modify the mortgage unless the homeowners has tens of thousands of dollars to put down towards the new loan. In my client’s case, as in the case of most homeowners, this was not possible.

This scenario causes, in my view, more trials than are necessary since it is so difficult to settle by a loan modification. In this trial which started on November 27, 2013, the results ended favorably for my client. In this Philadelphia County case, HSBC was demanding that my client come up with over $60,000 in order to reinstate his mortgage loan (which already contained a 10.9% interest rate). My client rejected the offer, and the case proceeded to trial. Midway through the trial, HSBC made an offer to let our client remain in the home for almost another 12 months, and to waive the entire unpaid loan amount of $177,000. The case has been in litigation for nearly 3 years so this was a fantastic result for my client. The terms of the settlement were put on the record in front of the judge.

Foreclosures Surge in DC Area After Federal Budget Cuts – Could Pass New Jersey in Foreclosure Rates

According to reports released by the Bipartisan Policy Center, this year’s across-the-board budget reductions have led to “sequester pain.”  Federal agencies award more than $500 billion a year, or roughly $1.4 billion dollars a day, to tens of thousands of contractors, with late payments, halted work and canceled solicitations accumulating, to the detriment of companies and their workers. Initial foreclosure filings for September climbed 144 percent since August in Fairfax County, Virginia; they more than doubled in Prince William, Loudoun and Fauquier counties.  New Jersey’s 55 percent monthly increase in foreclosure starts is the highest in the United States. Virginia is the second-highest in the US with a 52 percent monthly increase in foreclosure starts.  Virginia is likely to see another surge, and may surpass New Jersey, as an estimated 800,000 federal workers, including Defense Department inspectors and auditors who help certify invoices, were furloughed when the shutdown began at the beginning of October.   Full article.

In September, the number of properties that received a foreclosure filing in NJ was 55% higher than the previous month – and 55% higher than the same time last year. Home sales for August 2013 were down 4% compared with the previous month, and down 2% compared with a year ago. The median sales price of a non-distressed home was $298,000. The median sales price of a foreclosed home was $185,000, or 38% lower than non-distressed home sales.
